How do you know he was texting? There are a number of reasons this driver may have been distracted. Maybe he was filming the guy in the car behind him.
I would guess that he was drunk. The poster is misrepresenting using the video to make a political statement. This is a FAR MORE likely explanation. Even the self who made the video doubts he is texting.
I have to agree that unless more fine points are given you do not know if he was texting, drunk, having a medical issue, etc. I am all for outlawing texting even as pouring but this video does not convince me that is what the cause of this accident was.

Defintiely don’t text and drive, but also don’t video tape and drive. Both drivers were distracted here, but at least the guy recording was not also in an accident – but he could have been as well.
This happened to me once. I’m glad I have bluetooth in my car because the correspondent yelled at me for being on my phone even as pouring. haha. “And why are you calling even as you are pouring to report someone who is texting even as pouring ma’am?” “Um….I have bluetooth sir.” “…..oh….”
